Please read these terms carefully. By creating a Text2Ticket account or using our service, you agree to be bound by these Terms of Service. If you do not agree, do not use the service.

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and Text2Ticket ("Text2Ticket," "we," "us," or "our") governing your access to and use of the Text2Ticket platform, including the web dashboard, SMS processing service, report generation engine, and all related features (collectively, the "Service").

2. Description of Service

Text2Ticket is a software-as-a-service (SaaS) platform that enables field service contractors to send job notes and photos via SMS to a dedicated phone number. Our AI-powered system processes these messages and generates professional job completion report PDFs, which are delivered to your clients by email.

3. Account Registration

To use the Service, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately at hello@text2ticket.com if you suspect unauthorized access to your account.

You represent that you are at least 18 years old and have the authority to enter into these Terms on behalf of yourself or the business entity you represent.

4. Introductory Pricing

New subscribers pay $47 for their first month of service, which includes full access to all features. After the first month, the subscription automatically renews at the standard rate of $197 per month. If you cancel before your second billing date, you will not be charged the standard monthly rate. Payment information is required at signup.

5. Payment Terms

Pricing: The Service is offered at $47 for the first month, then $197 per month (billed monthly) or $1,970 per year (billed annually). Prices are subject to change with 30 days' notice.

Billing: Subscriptions are billed in advance on a recurring basis (monthly or annually, depending on your plan). Payments are processed via our secure third-party payment processor. By providing payment information, you authorize us to charge your payment method on a recurring basis.

Taxes: You are responsible for all applicable taxes associated with your subscription.

Failed Payments: If a payment fails, we will attempt to retry the charge. If payment is not received within 7 days, your account may be suspended.

No Refunds: Except as required by applicable law, subscription payments are non-refundable. If you cancel mid-period, you retain access through the end of your current billing period.

6. Cancellation Policy

You may cancel your subscription at any time from your account dashboard or by contacting us at hello@text2ticket.com. Cancellation takes effect at the end of your current billing period. You will not be charged after cancellation. Upon cancellation, your account data will be retained for 90 days before deletion, during which time you may request an export of your data.

You agree to use the Service only for lawful business purposes. You must not:

8. SMS Compliance

You are responsible for ensuring that technicians who text your Text2Ticket number have consented to receiving automated communications as part of their employment or contractor relationship with you. You agree to comply with all applicable SMS and telecommunications laws, including the Telephone Consumer Protection Act (TCPA) and carrier guidelines.

9. Your Data & Content

You retain ownership of all data, content, and information you provide to the Service, including job notes, photos, client information, and company branding. By using the Service, you grant Text2Ticket a limited, non-exclusive license to process, store, and transmit your content solely to provide the Service to you.

We may use aggregated, anonymized data derived from the Service to improve our AI models and platform. We will never sell your identifiable data to third parties.

10. Intellectual Property

The Text2Ticket platform, including its software, AI models, design, and branding, is owned by Text2Ticket and protected by applicable intellectual property laws. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service as described herein.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, TEXT2TICKET DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED REPORTS WILL BE ACCURATE OR COMPLETE IN ALL CASES. YOU ARE RESPONSIBLE FOR REVIEWING ALL REPORTS BEFORE SENDING THEM TO CLIENTS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TEXT2TICKET SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO TEXT2TICKET IN THE THREE MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify, defend, and hold harmless Text2Ticket and its officers, directors, employees, and agents from any claims, liabilities, damages, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

14. Termination

We may suspend or terminate your account at any time if you violate these Terms, if required by law, or if we discontinue the Service. We will provide reasonable notice where practicable. Upon termination, your right to use the Service ceases immediately.

15. Governing Law & Disputes

These Terms are governed by the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved through binding arbitration on an individual basis. You waive any right to participate in a class action lawsuit or class-wide arbitration. Nothing in this section prevents either party from seeking injunctive relief in a court of competent jurisdiction.

16. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice in your dashboard. Continued use of the Service after the effective date of changes constitutes your acceptance. If you do not agree to updated Terms, you may cancel your subscription before the changes take effect.
